Eby sentenced

Stephanie Lopez Eby, Sharon Springs, appeared in The Wallace County District Court on June 13, 2018, with her lawyer Michael Day of St. Francis. Eby was originally charged with Count 1 - Possession of opiate, opium, narcotic, or certain stimulant, Count 2 - Burglary, Dwelling to commit felony, theft or sexually motivated crime, and Count 3 - Theft of property or services, Value less than $1500 from December of 2017. Eby entered into a plea agreement where she agreed to plead “no contest” to Count 3 Theft, in exchange, the other counts would be dropped. Judge Showalter asked Eby if she understood the terms of her plea agreement and if she entered into the agreement willingly. Eby acknowledged her agreement to the terms and the understanding that she waived her right to appeal and that she had ample time to consult with her attorney considering these rights. Showalter announced that the court accepted the Defendant’s plea of no contest to Count 3 - Theft, and per the agreement, dismissed Counts 1 and 2. Eby was assessed Court Costs of $158, 6 months in jail (sentence suspended for 24 months) and was placed on supervised probation. She was ordered to pay all fines, fees, and costs, to surrender her CNA Certification, obtain a drug and alcohol evaluation, and successfully complete all recommendations of the evaluation.
