The Honorable Judge Scott Showalter handed down sentences in 7 drug related arrests, most of these stemming from the massive multi-county arrest August 2017.
Matthew Henry Hessler appeared in court with attorney Colton Eikenberry, Hays, KS. He had been charged with Unlawful Distribution of a Controlled Substance, Marijuana, severity level 4, nonperson drug felony, which carries a presumptive 24-month prison sentence. He was also charged with Unlawful Distribution of a Controlled Substance, Marijuana, severity level 3, nonperson, drug felony, that carries a 56-month prison sentence. Hessler plea “no contest” as part of a plea agreement on April 11th. During sentencing he was granted a downward departure of 24 months of probation for the first charge and 56 months of probation for the second charge. Judge Showalter agreed to the term of sentencing set forth by Wallace County District Attorney Charles Moser. Hessler was ordered to pay a combined $2986 in restitution, court costs and few associated with both cases.
Tyson Roy Owings appeared in court with attorney Joseph Bain, Goodland, KS. He was charged withUnlawful Distribution of a Controlled Substance, Marijuana, severity level 3, nonperson drug felony that carries a presumptive 68 months prison sentence. Owings plead guilty on June 13, 2018. During sentencing a downward departure of 68 months of probation was offered to Owings. Judge Showalter accepted the plea agreement and sentencing recommendations. Owings was ordered to pay a total of $1080.50 in restitution, court costs, and fees associated with the case.
Wendy F. Huthansel appeared with attorney Colton Eikenberry, Hays, KS. She had been charged with Conspiracy to Distribute Methamphetamine, level 3, nonperson drug felony that carried a presumptive 58 months in prison sentence. On April 11, 2018, Huthansel plead “no contest” to the charges in a plea agreement granting her a downward departure to 58 months of probation. Judge Showalter agreed to the terms of the plea agreement and ordered Huthansel to pay a total of $1080.50 in restitution, court costs, and fees associated with the case.
Kyllian Jamie Wright appeared with his attorney Douglas C. Spencer, Oakley, KS. He had been charged with Unlawful Distribution of a Controlled Substance, Marijuana, severity level 3, nonperson drug felony that carries a presumptive punishment of 54 months in prison. Wright plead guilty to the charge on April 27, 2018. As part of a plea agreement, he was offered a downward departure of 54 months of probation. Judge Showalter accepted the plea arrangement and ordered Wright to pay a total of $1313 in restitution, court costs, and fees associated with the case.
Ashley Dawn Hildebrand appeared in court with attorney Douglas C. Spencer, Oakley, KS. She had been charged with Unlawful Distribution of a Controlled Substance, Methamphetamine, a level 2 nonperson drug felony with a presumptive sentence of 108 months in prison. Hildebrand plead “no contest” and was offered a downward departure of 108 months of probation. Additionally, Hildebrand was ordered to pay a total of $1363 in restitution, court costs, and fees associated with the case.
Kirk Logan Stone appeared with his attorney Douglas C. Spencer, Oakley, KS. He had been charged with Possession of Controlled Substance with Intent to Distribute, Marijuana, a level 2 nonperson drug felony that carried up to a 111-month prison sentence. Stone plead guilty as part of a plea arrangement and was offered a downward departure of 111 months of probation. Judge Showalter ordered Stone to pay a total of $613 in restitution, court costs, and fees associated with the case.
