Brandon and Fugate Sentenced

Jonathan Brandon appeared in Wallace County District Court on April 10th, 2019, with his court appointed attorney, Steve Cott, Garden City, for sentencing in cases 17 CR 51 and 17 CR 58. Each case charged Brandon with Distribution of Methamphetamine within 1000 feet of a school, a severity level 1 nonperson drug felony. Both carry a presumptive sentence of 187-169 months in prison. In a plea agreement reached with Brandon, the Wallace County Attorney’s Office recommended a downward departure from the presumptive prison sentence. The Honorable Judge Showalter accepted the terms of the plea agreement. Brandon was sentenced to 178 month in prison, but was granted a downward departure in his sentence, placing him on probation. In addition to probation, Brandon has been ordered to pay $900 in restitution to the Kansas Bureau of Investigation, $193 in court costs, and $820 in other fees related to the 17 CR 51. In the matter of 17 CR 58, Brandon was also given a downward departure from the sentence that is to run concurrently with the probation in case 17 CR 51, and ordered to pay $1,520 in restitution to the KBI, $193 in court costs, and $820 in other fees related to the case.

William Fugate appeared in Wallace County District Court on April 10th, 2019 with attorney Robert Gale, Syracuse on the matter of 18 CR 28. Fugate plead guilty to Amended Count 1, Unlawful Possession of a Controlled Substance, (marijuana) Count 2, Possession of Drug Paraphernalia, and Count 3, Possessions of Drug Paraphernalia. In a plea agreement reached with the Wallace County Attorney’s Office, Fugate was offered probation in exchange for testifying against his co-defendants and pleading guilty. The Hon. Judge Showalter agreed to the terms of the plea agreement, placing Fugate on probation and ordering him to pay a $100 fine, make a $400 donation to the Wallace County Foundation, and pay all court costs and attorney’s fees.
