District Court update

Miles Ackerman appeared in Wallace County District Court on January 16th, 2019 with attorney Douglas Spencer, Oakley, for sentencing on the charge of Unlawful Distribution of a Controlled Substance (methamphetamine) within 1000’ of a school, a level 1 nonperson drug felony, which carries a presumptive prison sentence of 146-162 months. In exchange for pleading guilty, Ackerman was offered a downward departure on his sentence. Judge Showalter honored the terms of the plea agreement and sentenced Ackerman to probation. Ackerman was further ordered to pay $900 in restitution, $193 court costs, and $820 in other fees related to the case.

Dabney Jacob appeared in Wallace County District Court on January 16th, 2019 with attorney Christopher Rohr, Colby, for sentencing on a charge of Unlawful Distribution of a Controlled Substance (methamphetamine) a level 2 non-person drug felony, which carries a presumptive prison sentence of 105-116 months. In exchange for pleading guilty, Jacob was offered a downward departure on his sentence. Judge Showalter honored the terms of the plea agreement and sentenced to probation. Jacob was ordered to pay $1,160 in restitution, $193 in court costs, and $820 in other fees related to the case.

Deric Guy appeared in Wallace County District Court on January 24th, 2019 with attorney Steve Cott, Garden City, for sentencing on a charge of Unlawful Distribution of a Controlled Substance (methamphetamine) a level 3 non-person drug felony, which carries a presumptive prison sentence of 51-57 months. The Hon. Judge Scott Showalter sentenced Guy to 54 months with the Kansas Department of Corrections and ordered 36 months post release supervision. Guy was also ordered to pay Court Costs of $193, and $895 in other related fees.

Nina Cearley, Wallace, appeared in Wallace County District Court on January 30, 2019 with her attorney, Leslie Beims, Goodland. In exchange for pleading guilty to count 1 - Giving a Worthless Check, count 2 was dismissed. Cearley was given a 90-day sentence, suspended with 6 months of supervised probation, ordered to pay $42.13 in restitution, $60 return check fee, $13.40 postage, $20 bad check fee, $158 court costs, and attorney’s fees as submitted.

Kodie Guay appeared in Wallace County District Court with his lawyer Christopher Rohr, Colby before the Hon. Steve Unruh on January 25th, 2019. Guay had been charged with three separate counts of Giving a Worthless Check, in violation of K.S.A. 5821, a class A misdemeanor. In a plea agreement reached, Guay plead guilty to Count 1, the State of Kansas dismissed Count 2 and 3. Guay was ordered to pay restitutions for all 3 counts in the amount of $159.44, $90.49, and $49.31. He was further ordered to pay $50 in bad check fees, made payable to the Wallace County Worthless Check Fund, as well as a total of $474 in court costs ($158 per count) and attorney’s fees as submitted. Guay was placed on 6 months of unsupervised probation.
