The Sharon Springs City Council met in regular session Monday, May 5, 2025 at 5:30 p.m. Those present were Mayor Verlan Wagoner and Council Members: President of the Council Jay Sharp, Steve Paul, Tim Elder, AB Smith, Dennis Mote, City Attorney Allan Hurlburt, City Clerk Angie Van Allen, Deputy Clerk Allison Mitchell, City Foreman Donald Henderson, Megan Cox, and Sheriff Marshall Unruh.
Mayor Wagoner called the regular meeting for Monday, May 5, 2025 to order at 5:30 p.m.
A building permit submitted by Megan Cox was reviewed. Mr. Paul made a motion to approve the building permit as presented. Mr. Elder seconded the motion, motion approved. A building permit by Johnny Unruh was reviewed. Mr. Unruh was not present at the meeting. Mr. Sharp made a motion to approve the building permit as presented. Mr. Mote seconded the motion, motion approved.
Sheriff Unruh discussed with council a revised firework ordinance now in effect and his current contract with the City. Sheriff Unruh has requested an increase in pay. Mr. Elder made a motion to approve the increase in pay for Mr. Unruh as discussed. Mr. Smith seconded the motion, motion approved. Mr. Hurlburt will prepare the new contract.
The Bed Tax Committee has revised the Wallace County Transient Guest Tax Guidelines and Policy form. Council was presented Bed Tax requests in the amount of $1,075.00 from the Ft. Wallace Rodeo for the 71st annual rodeo to be held Memorial weekend and also a request from the Wallace County Cruizers for the May 2025 Car Show in the amount of $956.00. Mr. Paul made a motion to approve the revisions to the guideline policy from the Bed Tax Committee. Mr. Sharp seconded the motion, motion approved. Mr. Mote made a motion to approve the request from the Ft. Wallace Rodeo. Mr. Smith seconded the motion, motion approved. Mr. Mote made the motion to approve the request from the Wallace County Cruizers. Mr. Elder seconded the motion, motion approved.
Council discussed a proposal from Skyler Rain on a petition for an alley vacate pursuant to K.S.A. 12-504. Mr. Sharp made a motion to approve this alley vacate request. Mr. Mote seconded the motion, motion approved. Mr. Hulburt will prepare the Notice for Hearing.
Council discussed the sidewalk entrance to the Ministerial Alliance Food Pantry. Council would like an updated bid from A & D Concrete, LLC. The latest bid was estimated at $18,600.00. Mr. Sharp made a motion to approve a revised bid from A & D Concrete, LLC if it is subject to an increase of less than 10%. Mr. Mote seconded the motion, motion approved. Council tabled discussion on the sidewalk around the Senior Center.
Mr. Paul moved to approve the regular meeting minutes of April 7, 2025. The motion was seconded by Mr. Elder, motion approved.
Mr. Elder moved to accept payroll and vouchers as presented: manual checks#31813-#3129; payroll checks-#31830-#31844; voucher checks - #31845-#31861; ACH’s #721-#725. Mr. Sharp seconded the motion, motion approved.
Requisitions were presented to Council. Mr. Smith made a motion to approve requisitions. The motion was seconded by Mr. Paul, motion approved.
City Superintendent Report: City Foreman Donald Henderson updated council. KMEA in April assisted with a fault protection by breaker. In June KMEA-Midstates will set the breaker at the substation. B & H Paving will do chip sealing at the end of May for (west side) including Front, Second, Third, Fourth and Fifth Streets. Inland Potable will do inspection and dive the tank this upcoming summer. Mr. Henderson submitted a bid proposal in the amount of $16,000.00 from Jesse Mudd for a 2021 Grizzly Mosquito Fogger with OPS capabilities. Mr. Mudd would deliver. Motion made by Mr. Smith to purchase the mosquito fogger for the amount of $16,000.00. The motion was seconded by Mr. Elder, motion approved. Discussion was reintroduced on stump grinding at the City Park. All bids were considered. Mr. Mote made a motion to accept the bid submitted by Lance Finley in the amount of $1,200.00 for the grinding of 10 stumps (no cleanup included). Mr. Elder seconded the motion, motion approved. Council would like to have revised quotes from Core and Main and Midwest Meter on digital water meters.
City Attorney Report: At 6:56 pm Mr. Hurlburt requested a 15-minute executive session with the Council for attorney-client privilege. Mr. Paul made the motion, Mr. Smith seconded the motion, motion approved. Clerk Van Allen, Deputy Clerk Mitchell and Mr. Henderson were dismissed. At 7:11 pm Clerk Van Allen and Deputy Clerk Mitchell were invited back in to the meeting. Mr. Hurlburt left the meeting.
Council Member Reports: At 7:12 pm Mayor Wagoner requested a 5-minute executive session with the Council for non-elected personnel. Mr. Elder made the motion, Mr. Sharp seconded the motion, motion approved. Clerk Van Allen, Deputy Clerk Mitchell were dismissed. At 7: 17 pm Clerk Van Allen and Deputy Clerk Mitchell were invited back in to the meeting. Mr. Sharp made a motion to approve the hiring of two part-time/summer employees. Mr. Elder seconded the motion, motion approved. The new hires will have a start date of May 12, 2025. At 7:20 pm Mr. Smith made a request and motion for a 10-minute executive session for non-elected personnel. Mr. Mote seconded the motion, motion approved. At 7 :30 pm an additional 5 minutes was requested by Mr. Sharp for non-elected personnel. Mr. Mote seconded the motion, motion approved. Clerk Van Allen, Deputy Clerk Mitchell were dismissed. At 7 :3 5 pm Clerk Van Allen and Deputy Clerk Mitchell were invited back in to the meeting. Proposed 5 Year Plans for both Equipment Reserve and Capital Improvement were reviewed. Mr. Elder made a motion to approve the 5 Year Capital Improvement Plan. Mr. Sharp seconded the motion, motion approved. Mr. Paul made a motion to approve the 5 Year Equipment Reserve Plan. Mr. Mote seconded the motion, motion approved. Council members have agreed to allow City Clerk to move an estimated 1.4 million dollars from the checking account to the HYMM account to allow for more interest to be earned.
