Sharon Springs City Council - October 2023

The Sharon Springs City Council met in regular session Tuesday evening, October 5, 2023 at 5:30 p.m. Those present were Mayor Patrick Gibbs, Council Members: Amber Fischer, Tim Elder, Verlan Wagoner, Dennis Mote, Jay Sharp, City Attorney Allan Hurlburt, City Clerk Wendy Keadle, Deputy Clerk Allison Mitchell, City Superintendent Dennis Sharp, Jon & JoAnn Voth.  
Mayor Patrick Gibbs called the regular meeting for September 5, 2023 to order at 5:30 p.m. Mayor Gibbs stated there was an amendment to the agenda to appoint Wendy Keadle as City Clerk and Allison Mitchell as Deputy Clerk. Mr. Mote Motioned to appoint Wendy Keadle as City Clerk, Mr. Sharp seconded the motion, motion passed. Mrs. Fischer made a motion to appoint Allison Mitchell as Deputy Clerk, the motion was seconded my Mr. Wagoner, motion passed.
The Building Permit for Jon Voth was discussed. Mr. Sharp made a motion to pass the Building Permit for Jon Voth, seconded by Mr. Wagoner, motion passed.
The WCC, Inc. Preparation and Consulting Agreement was discussed.  There was not a defined amount the city would be charged in the agreement. This will be looked into further and will be tabled until the November 6th, 2023
The Mapes & Miller Engagement Letter for the Audit for 2023 was presented and discussed.  Mrs. Fisher moved to approve the Mapes & Miller Engagement Letter for the 2023 Audit, Mr. Sharp seconded the motion, motion passed.
The Emergency Water Plan Annual Review was submitted.  Mr. Elder motioned to pass the Emergency Water Plan, Mr. Wagoner seconded the motion, motion passed.
Mr. Mote moved to approve the special meeting minutes of the September 27th meeting at 6:00 pm, motion was seconded by Mr. Wagoner, motion approved.
Mr. Wagoner moved to accept payroll and vouchers as presented, Mr. Mote seconded the motion, motion approved.
Mr. Sharp moved to approve the requisition as presented, Mr. Elder seconded the motion, motion approved.
City Superintendent Report: City Superintendent Dennis Sharp gave his monthly report
City Attorney Report: Mr. Hurlburt notified Council that Mark E. Helstrom had filed a Lawsuit against the City of Sharon Springs for an emergency stay on the 30 day time frame for taking and/or the destruction of the private property at 404 Elm St, Sharon Springs KS. Mr. Hurlburt appeared at the Wallace County Courts and advised there were never any papers served to the Mayor or the City Clerk concerning this matter.  Mr. Hurlburt advised that Mr. Helstrom could not prove with any documentation that he was the rightful owner of this property.  The Injunction was denied by the courts.  The appeal bond is set at 5,000.00 cash that would need to be filed with any appeal request. Mr. Hurlburt advised to wait until action is taken.
Council Member Reports:  Mr. Sharp discussed Sunday sales for Cereal Malt Beverage.
City Clerk Report:  No report

Water usage report for the water wells was included in the council packets. 
Mr. Sharp moved to adjourn the meeting at 6:00 p.m.; Mr. Mote, seconded the motion, motion approved.
