The Sharon Springs City Council met in regular session Tuesday evening, September 5, 2023 at 5:30 p.m. Those present were Mayor Patrick Gibbs, Council Members: Amber Fischer, Tim Elder, Yerian Wagoner, Dennis Mote, City Attorney Allan Hurlburt, City Clerk Theresa Hill, City Superintendent Dennis Sharp, Wendy Keadle, Stephanie Heier and Torrey Elder.
Mayor Patrick Gibbs called the regular meeting for September 5, 2023 to order at 5:30 p.m. Mayor Gibbs stated at the Council Meeting on August 7th 2023 the Budget Hearing and approval of the budget was inadvertently approved and did not follow the
Notice of Hearing date in the published newspaper. As of today, September 5, 2023, Mayor Gibbs opened the Revenue Neutral Rate Hearing and Budget Hearing.
Stephanie Heier, Auditor for Mapes and Miller presented the 2022 Audit report. Mrs. Heier explained the compliance guide that auditors are required to comply with and detailed the Audit report for the City Council. Mrs. Fisher made the motion to approve the 2022 Audit report, motion was seconded by Mr. Elder, motion approved.
Four new members were presented for approval for the Bed Tax Committee: Aarika Welsh, Natalie Cox, Kari Cox and Loretta Lamb. Motion was made by Mrs. Fischer to approve the new Bed Tax Members, Mr. Wagoner seconded the motion, motion approved.
Torrey Elder approached the Council regarding Cereal Malt Beverage sales on Sunday's. Mr. Hurlburt explained the process of CMB Sunday sales. The Council will need to take a vote for approval to begin the process. Motion was made by Mr. Wagoner to promote CMB sales on Sunday's, Mr. Elder seconded the motion, 3 yea (Wagoner, Elder, Mote), 1 abstain (Fischer), motion approved. This will be Ordinance #555.
Mrs. Fischer moved to pass an Ordinance Regulating Traffic Within the Corporate Limits of the City; Incorporating by References the Standard Traffic Ordinance for Kansas Cities, Edition 2023. Mr. Mote seconded the motion, motion approved. This will be Ordinance #553.
Mr. Mote moved to pass an Ordinance Regulating Public Offenses Within the Corporate Limits of the City; Incorporating by References the Uniform Public Offense Code of Kansas Cities, Edition 2023. Motion was seconded by Mrs. Fischer, motion approved. This will be Ordinance #554
Mr. Wagoner moved to approve the minutes of the August 7th regular meeting, Mr. Mote seconded the motion, motion approved.
Motion was made by Mr. Elder to approve the special meeting minutes of the August 16th meeting, Mr. Mote seconded the motion, motion approved.
Mrs. Fischer moved to approve the special meeting minutes of the 6:30 pm meeting on August 28th, motion was seconded by Mr. Mote, motion approved.
Mr. Wagoner moved to approve the special meeting minutes of the August 28th
meeting at 7:00 pm, motion was seconded by Mr. Mote, motion approved.
Mrs. Fischer moved to accept payroll and vouchers as presented: voucher checks 30607-30626; manual checks - 30627-30644, ACH #552 & #553; payroll checks - 30645-30665, ACH #1, Mr. Wagoner seconded the motion, motion approved.
Mr. Mote moved to approve the requisition as presented, Mr. Elder seconded the motion, motion approved.
City Superintendent Report: City Superintendent Dennis Sharp reported Dustin Bozarth resigned effective September 8, 2023. Mr. Mote moved to accept Mr. Bozarth's resignation, motion was seconded by Mrs. Fischer, motion approved.
City Attorney Report: No Report.
Council Member Reports: Mr. Elder reported to the Council that Sam Rodriguez had passed his Water Certification test. Superintendent Sharp stated he is being trained to run the power plant and other duties. At 6:08 p.m. Superintendent Sharp asked to enter into executive session. Mrs. Fischer moved to go into executive session to discuss non-elected personnel for 5 minutes inviting Council members, Clerk Hill and Wendy Keadle to attend. Mr. Elder seconded the motion, motion approved. Mr. Hurlburt left the meeting. At 6:13 p.m. City Council meeting resumed. Mr. Elder moved to give Samuel Rodriguez a $1.00 per hour raise for passing the Water Certification test effective September I, 2023, motion was seconded by Mr. Wagoner, motion approved. Mr. Mote made the motion to give Samuel Rodriguez a performance raise for an additional .50 per hour effective September 1, 2023, motion was seconded by Mrs. Fischer, motion approved.
City Clerk Report: No report.
Mr. Wagoner moved to exceed the Revenue Neutral Rate (RNR) for 2024, Mr. Mote seconded the motion, motion approved. Mr. Elder made the motion to take a Roll Call Vote on the RNR, 4 yea (Wagoner, Mote, Fischer, Elder) to exceed the RNR and adopt Resolution #2023-06, Mrs. Fischer seconded the motion, motion approved. Motion was made by Mrs. Fischer to close the RNR Hearing and adopt Resolution #2023-06, seconded by Mr. Mote, motion approved.
Mr. Elder moved to close the 2024 Budget Hearing, Mrs. Fischer seconded the motion, motion approved.
Mr. Wagoner motioned to approve the 2024 Budget, motion was seconded by Mr.
Mote, motion approved.
