Commissioner Proceedings 8/27/24

The Wallace County Board of Commissioners met in regular session with, Larry Townsend, Chairman, Michael Cowles, Commissioners, Becky Larson, Commissioner, and Micaila Lock, County Clerk present.   
Warrants # 31625 – 31676 in the amount of $ 302,435.95 were approved for payment. Payroll warrants in the amount of $149,642.39 for the working period of August 4,2024, through August 17, 2024, were approved for payment.

Maggie discussed her concerns about the appraiser office with everything that is coming up for taxes statements.

RESOLUTION NO. 2024-15
A RESOLUTION FOR PROHIBITING THE USE OF CERTAIN
DESIGNATED ROADWAYS IN WALLACE COUNTY, KANSAS
AS THOROUGHFARES BY CERTAIN VEHICLES
WHEREAS, K.S.A. 19-101a, and amendments thereto, provides the Board of County Commissioners to legislate on matters of local concern. 
WHEREAS, the Board of County Commissioners of Wallace County, Kansas has determined that it is in the best interests of public safety, during construction on U.S. Highway 40, to prohibit certain use of designated roadways in Wallace County, Kansas as thoroughfares by certain vehicles.  
WHEREAS, K.S.A. 8-2002, and amendments thereto, authorizes the Board of County Commissioners to prohibit or regulate the use of heavily traveled streets and roads by any class or kind of traffic that is found incompatible with normal and safe movement of traffic.
WHEREAS, K.S.A. 8-1912, and amendments thereto, authorizes the Board of County Commissioners to prohibit the operation of commercial trucks or other commercial vehicles on designated roadways.
NOW, THEREFORE, based upon all matters known and presented to it, the Board of County Commissioners finds and concludes that:
1. Commercial truck traffic over the county-maintained streets and roadways contributes to accelerated wear and tear of the roadway surfaces which are not designed for truck traffic. In addition, portions of these streets and roadways are heavily used by automobile and other traffic and are not suitable or safe as high speed transport ways for heavy truck traffic.
2.  It is in the best interests of the public safety and is reasonable and advisable to restrict the use of those portions of the following described County roads as through ways by commercial truck traffic for public safety and the maintenance and well-being of the county roads.
NOW, BE IT RESOLVED by the Board of County Commissioners of Wallace County, Kansas that the following traffic regulations be and is hereby adopted:
SECTION 1.  That for the purpose of this Resolution “commercial vehicle” means any motor vehicle, other than a passenger vehicle, and any trailer, semitrailer or pole trailer drawn by such motor vehicle, which vehicle is designed, used and maintained for hire, compensation, profit, or in furtherance of commercial enterprise.  This designation shall apply to all vehicles in excess of 24,000 lbs. in gross vehicle weight (GVW).  “Commercial vehicle” shall not include any motor vehicle used exclusively for the purpose of transporting students to school or any school sanctioned event.
SECTION 2.  County Road 6 from US Highway 40 south to Gooseberry Road and County Road 26 from US Highway 40 south to Field Road are hereby determined and designated as a roadways not available for use by commercial vehicles.
SECTION 3.  The prohibition of vehicle usage shall not be applicable to vehicles which are engaged in any of the following uses:
1. Emergency services by any fire, police, ambulance, or other governmental service entity including schools.
2. Construction, repair, or maintenance of a public or governmental utility upon property located along or reasonable accessible only from the designated street or roadway.
3. Construction, repair, or maintenance of streets or roadways by or under the direction of the County.
4. Construction or the delivery of construction materials for a construction project authorized and permitted by the County located along or reasonably accessible only from the designated street or roadway, but only during normal construction hours for the duration of the project and subject to scheduling, when necessary, by authorized County personnel.  
5. The delivery or carrying of goods, services, wares or other products to and from any location along or reasonably accessible only from the designated streets and roadways.
6. The normal residential use of property located along or reasonably accessible only from the designated streets or roadways.
7. When detoured onto county roads by law enforcement for public safety.
8. When the point of origin or destination is within Wallace County, Kansas.
SECTION 4.  Violation of this Resolution shall be classified as a Class C Misdemeanor.  Each violation shall constitute a separate offense.  Persons cited for violation of this Resolution shall be issued a citation or uniform notice to appear before the District Court of Wallace County, Kansas to answer for the charge of violating provisions of this Resolution.
SECTION 5.  The Wallace County Road and Bridge Department, or its designee, as determined by the Wallace County Road and Bridge Director, shall erect and place appropriate signage to give notice of this regulation at appropriate entrances to said roadway.  The use of prohibited truck traffic signs is authorized on said roadway restricted under this Resolution, with placement at the discretion of the County Engineer.
SECTION 6. This Resolution shall take effect and be in full force from and after its passage and publication once in the official County newspaper.
IT IS SO RESOLVED by a majority vote of all members of the Board of County Commissioners of Wallace County, State of Kansas, on this 27 day of August, 2024.

Doug discussed the landfill and agreed to putting the landfill hours on Facebook
Anthony Garica discussed the rollover accident and getting a stop sign at Jackrabbit Road and Road 17A and getting a resolution to put those signs up. He talked about the conditions of the roads and ditches looking. 
Marshall Unruh, Re- entered the meeting 
Marshall discussed the 911 dispatch having to partner with Sherman County and Hamilton County, that way if something was to happen to with the system our dispatchers can go up to Sherman to take calls for Wallace County. Also, Hamilton County can take calls for Wallace County in case of the systems being down. He also discussed the progress of the bridge projects in the county.
Commissioner Cowles made a motion to approve the August 13th, 2024, minutes, as amended. Commissioner Larson Second.  AYE 3   NAY 0 
Alicia Collett, Representing the Bed & Breakfast entered the meeting. 
Alicia discussed getting gutter over the annex part of the bed and breakfast that the Rec Department and asked if the county would be willing to cover some of the cost on the gutter.
Commissioner Larson moved to approve the $1,527.89 for guttering around the annex that the Rec Department uses for free. Commissioner Cowles Seconded  AYE 3   NAY 0

Aaron Brinkerhoff, District Manager of Optavise entered the meeting
Aaron discussed what his company has to offer with Washington National and getting the promotion to come out and talk to the employees.

Kathy gave updates on the door progress at the senior center. 
Lissa Sexson, Wallace County Community deployment entered the meeting. 
Lissa discussed the grant for the county road that need repaired to help prevent the roads from washing out. She talked about the safe route to school and when she plans to meet with the committees for both schools. Along with discussing housing intensive, storefront and signage and recruitment intensive.
Discussed putting in some fresh wood chips in at the north part 
Ryan Jansen, Lance Lise, and David Gilmore, County appraiser candidate entered the meeting via phone
The three of them discussed what they could do for the county to help as far as appraiser work. 
Kim Frodin, County Appraiser Candidate entered the meeting. 
Kim discussed how an appraiser office should work to run smoothly. She is willing to come half a day on Tuesdays and all day on Wednesday. How to improve some of the mapping systems that we have for the county. Getting an agreement wrote up for the county she is currently the county appraiser and being the Wallace County new appraiser.
